WESTERN SAHARA RESOURCE WATCH 18.01 - 2010
Mientras la UE lleva a cabo la revisión de su política pesquera, 25 ONGs saharauis han recomendado que ésta siga las leyes internacionales y que detengan la pesca en el Sahara Occidental ocupado. Las organizaciones representan a la gran mayoría de los grupos de la sociedad civil Saharaui en los territorios ocupados del Sahara Occidental y en los campos de refugiados del sudoeste de Argelia.
Barcos en los que ondea la bandera de Estados Miembros de la UE pescan actualmente de forma ilegal en las aguas costeras del Sahara Occidental bajo el amparo del Acuerdo de Pesca entre la UE y Marruecos. En Diciembre de 2008, antiguo Asesor Legal de la UE, Hans Corell, , confirmó que el Acuerdo de Pesca es ilegal.
En su propuesta a la Comisión Europea, las veinticinco ONGs, que representan a prácticamente la totalidad de la sociedad civil del país ocupado del Sahara Occidental, trataron cuatro puntos:
1) Ningún Acuerdo de Pesca que involucre a Territorios Ocupados, debe ser firmado con las potencias que los ocupan, sinconsiderar los deseos y los intereses de los habitantes de estos territorios.
2) No se debería suscribir ningún Acuerdo de Pesca con gobiernos extranjeros si este tratado abarca territorios marítimos sobre los que dicha potencia no tenga soberanía.
3) Si al suscribir un acuerdo, los recursos de un Territorio Ocupado ilegalmente o un Territorio No Autónomo, corren el peligro de ser explotados en contra de las leyes internacionales, se deberán tomar todas las medidas necesarias para evitar tal eventualidad. Para ello se debe investigar si las actividades respetan los deseos e intereses de los habitantes de dicho territorio. Una estrategia clara y transparente debe ser adoptada para asegurar que los habitantes de ese territorio son consultados legítimamente y que dan su consentimiento al proceso.
4) En concreto, para cualquier futuro Acuerdo de Pesca entre la UE y Marruecos, instamos a que las aguas del Sahara Occidental sean excluidas de forma clara y explícita.
Las propuestas a la Comisión Europea sobre la revisión de la Política Común de Pesca se cerraron el 31 de Diciembre de 2009.
